Anonymous: Statuta Vallis Diverii

Library › Latin: Law › Statuta Vallis Diverii

These statutes govern the community of the Val Divedro, the Alpine valley in the Ossola that leads up to the Simplon pass. Their more than one hundred and twenty chapters begin with procedure in the council: if the consuls and councillors cannot agree, they must vote secretly with beans, and the majority prevails, with a fine of five imperial soldi for anyone who resists. Further chapters regulate attendance at the council when the bell is rung, the summer pastures in the high Alps, the movement of livestock, keeping foreign animals off the common grazing, damage done by beasts, and the work of muleteers who carried goods over the pass.

The statutes are a vivid source for the life of an Alpine community in the late Middle Ages, combining pastoral regulation with the organisation of the transit trade across the Simplon, as the sample’s rules for carriers and their oath at Easter show. They illustrate the strong traditions of local self-government in the valleys of the Ossola. Their date is not stated in the sample, but their language and institutions belong to the late medieval and early modern statutes of the Ossola valleys, which were often revised and confirmed over several centuries.
